By BEN NEARY 12/15/2009 CHEYENNE, Wyo. — The state of Wyoming paid $250,000 last year to the estate of a man who died of hypothermia after a state trooper decided not to drive out on a winter night in response to a passing trucker's report that someone was trying to flag down help along I-90. The trooper involved is no longer employed by the Wyoming Highway Patrol. His departure, said Patrol Administrator Col. Sam Powell, "was related to the incident." "Our policy was and is that the trooper will respond to a call for assistance," Powell said. "That was the policy before that crash, and it remains the policy today." The 2008 payment to the estate of Steven Richard Sabala, 34, of Sheridan, was listed among law enforcement claims paid by the state that the State Auditor's Office released to The Associated Press this fall in response to a public records request. Sabala died Dec. 26, 2006, at the Wyoming Medical Center in Casper. He had been a passenger early that morning in a pickup truck driven by Michael Ruiz, 30, of Rozet. Ruiz died at the scene when the 1997 Ford pickup he was driving eastbound on the interstate drifted off the roadway and overturned about 30 miles southeast of Buffalo, in Johnson County. The crash happened at about 2:30 a.m., near a highway rest area. Sabala survived the crash and then spent hours unsuccessfully trying to get passing motorists to stop and help him. The National Weather Service reports the low temperature at Buffalo on that day was 30 degrees. A passing trucker called Wyoming Highway Patrol dispatch at 2:42 a.m. and reported that a man was trying to signal for help along the roadway. The dispatcher handling the call told the trucker repeatedly, "We'll get him some help." In response to the trucker's call, the Highway Patrol dispatcher at 2:44 a.m. called Forrest P. Johnson, then a state trooper in Buffalo. The patrol's night shift ends at midnight, but troopers take calls at home until 3 a.m., when the morning shift takes over. The dispatcher told Johnson, "There's a man standing by the road trying to wave down help, or a ride." The dispatcher said that the trucker making the report said she almost had hit the man on the highway. After asking a few questions about the location and time of the call, Johnson responded, "let's wait for a second call." A dispatcher at the Buffalo Police Department called the Highway Patrol dispatch at 2:45 a.m. and said that Campbell County authorities had reported an incident to him at the same location. The Highway Patrol dispatcher declined the Buffalo dispatcher's offer to send an ambulance, noting that Johnson had said to wait for a second call. A second motorist called the Highway Patrol at 4:13 a.m. to report that a man was "on the floor" and was holding a sign asking for help. Trooper Ron Moseman then went out to the scene, where he found Sabala at about 5 a.m. Moseman's report on the accident lists the time of the accident at 2:40 a.m. and states police were notified at 4:14 a.m. Medical workers later flew Sabala from the Johnson County Health Care Center to the Wyoming Medical Center in Casper, where he died at 10:50 a.m. Johnson County Coroner David Harness wrote a report concluding that Sabala died from "hypothermia due to spending time in cold weather following an auto crash." A report in the Buffalo Bulletin dated Feb. 7, 2007 stated that Sabala's family had received an anonymous letter suggesting that a Highway Patrol trooper's failure to respond to a call for help might have contributed to his death. "You don't know what this has done to us," Beverly Geis, Sabala's mother, told the newspaper. "If they are trying to keep this quiet, it's the Highway Patrol that is. Somebody somewhere is very negligent and will be liable for this." Attempts to reach Geis for comment were unsuccessful. Records from the Wyoming State Auditor's Office show the state paid $250,000, the maximum allowed under state law, to a law firm representing Sabala's estate on April 2, 2008. Clint Langer, the Sheridan lawyer who represented Sabala's estate, declined comment. Sabala's sister, Jeanie Schlautmann of Gillette, also declined comment. Bruce Salzburg, Wyoming attorney general, said state law prohibited him from releasing the written claim that Sabala's estate filed against the state. The matter never went to court. State personnel records show Johnson's employment with the Highway Patrol ended March 10, 2007. A man who answered the telephone at a listing for Forrest P. Johnson in Buffalo declined to say whether he had worked for the Highway Patrol and declined comment. Powell said state personnel rules limited what he could say about why Johnson left the patrol a few months after Sabala's death. "All I can tell you is it was related to the incident," Powell said. Powell said the Highway Patrol didn't try to withhold details of the incident. "The facts are what the facts are," Powell said. "We never tried to cover anything up." Powell said Sabala's situation was frustrating for his agency. He said the first trucker's call didn't mention a crash, or any mention that the man needed medical help. He emphasized the trucker said the man was near a rest area. "We had limited information," Powell said. "Now the second call provided more detailed information, and a decision was made to respond." However, Powell said he would not maintain the patrol handled the first call about Sabala properly, even with the limited information it had. Whitacre Jr., the new chief executive of General Motors, really wants to make a point, he tends to repeat himself. And in his first two weeks on the job, Mr. Whitacre has been driving home the same message over and over to G.M. executives and employees. "You are accountable and responsible," he recalled saying on several occasions during an extended interview Monday, his first since taking over as chief executive on Dec. 1. "The success of this company depends on you and the things you do. Now go out and do it." In his new role as chief executive of G.M. as well as chairman, a post he has held since July, Mr. Whitacre is focusing on shaking up the automaker's famously bureaucratic culture by singling out individuals and giving them both the responsibility and authority to make things happen. "The only place there was any really solid accountability here was right at the top," said Mr. Whitacre, 68, delivering his blunt assessment of the corporate culture at G.M. in his soft-spoken Texas drawl. "I want to make sure people understand that the responsibility for this company to be successful is not just with the C.E.O.," he said. "It's them." "My style is really just to say, 'let's get going,' " he added. "Let's do something, let's move, and let's not be constrained by something that has happened in the past. Nobody is going to be fired for trying something new around here." The changes at the top have been profound for G.M., which has survived on $50 billion in government loans since collapsing financially last year. Mr. Whitacre's predecessor, Fritz Henderson, was ousted by G.M.'s board because directors were dissatisfied with the pace of change at the company since it emerged from bankruptcy over the summer. Mr. Whitacre said there was no longstanding plan by the board, or by the Obama administration, for him to replace Mr. Henderson. "The decision was made to make some more changes. It's really just about that simple," he said. "That's when the board asked me if I would step up and do this, and I volunteered." Since taking over, Mr. Whitacre has wasted no time. He has promoted several young executives to senior positions, including naming Mark Reuss, a 46-year-old engineer, as head of North American operations. Mr. Whitacre has also been meeting with employees at all levels of the company, including spending a day last week at G.M.'s pickup truck plant in Flint, Mich. He went to Flint in a sweatshirt and jeans, and picked a spot on the assembly line. "I made them let me put a hood on a truck," he said. "It looked like something I could handle." It is all part of the on-the-job education of Mr. Whitacre, who required some persuading from Steven Rattner, the head of the auto task force, before agreeing to join G.M. in the spring. "I didn't know if I was the right person, but Rattner and company convinced me that I could make a contribution," he said. "They got to my conscience." Auto analysts have argued that G.M.'s insular culture needed a dynamic outsider to shake up the organization. "An outsider may not do a lot of things that are different, but they can be more effective than the same old voices," said John Casesa, a former Wall Street analyst and currently an industry consultant. So far, Mr. Whitacre has focused on streamlining the management structure. He holds a regular Monday morning meeting with a dozen direct reports, but does not plan on attending strategy sessions in various divisions. "Ed's not sitting in a lot of meetings," said Stephen Girsky, a director who is acting as special adviser to Mr. Whitacre. "The plan is to get our A players in the right structure and then clear the bureaucracy out of the way so they can do their jobs." Mr. Whitacre is repeatedly reminding staff members that G.M. needs to serve its customers better, regardless of whether they design, build or sell cars. "Service is really important and we're going to be laser focused on that," he said. "You first have to have a management team that really believes in it." It is a lesson Mr. Whitacre learned as a young engineer working for Southwestern Bell in the 1960s. "Nobody wants their phone fixed in three days -- they want it that hour, and you can't blame them," he said. "Nobody wants to wait a month to have their car fixed, either." Moving up younger executives will energize the company, Mr. Whitacre said. He added that because G.M. is 60 percent government-owned and under pay restrictions, it is also easier to promote young managers rather than to lure more experienced -- and more expensive -- talent from the outside. Mr. Whitacre declined to get into the details of Mr. Henderson's departure, but said it was true that the board had some basic disagreements over how G.M. should be run. One such issue was management's decision to sell a majority stake in G.M.'s struggling European operations. "The board's mentality was, here's something we own, it has a lot of worth to it, and why would we walk away from this for very little money and be in a joint venture where we were a minority owner?" he said. Mr. Whitacre said he did not want to predict how long it would take to recruit a permanent chief executive for G.M. "I don't know if this is a one-month deal, a five-month deal or a one-year deal," he said. "We'll just have to see." He also would not predict when G.M. would be able to repay its government loans, but did underscore that doing so quickly was a priority. "It's going to be a pivot point," he said. City Recorder-Treasurer Ann Wright told the City Council Monday that a man from Little Rock came to claim a 1978 fire truck but it couldn't be found. The man provided a document saying the city has made no payments on the truck. Councilors said they don't remember when the purchase was approved. City Attorney Carolyn Whitefield says an attorney from Cook County, Ill., contacted her about three police cars. She says he claims the city defaulted on payments for the cars. The Arkansas State Police says the patrol cars were found in September at an auto dealership in Natchitoches, La., where a former Garland City police chief allegedly tried unsuccessfully to trade them for another vehicle.
